Terms of service

Article 1 (Purpose)

These Terms and Conditions (“Terms”) govern the use of the FROMLABS online store and related services (“Services”) provided by The Founders Inc. (“Company”) through its website (“Website”). These Terms describe the rights and obligations of all individuals (“Users”) who access or use the Services.

 

Article 2 (Definitions)

  1. “Website” means the online store operated by the Company through which Users may browse products, place orders, or access Services.
  2. “Users” include all individuals who access or use the Website, whether or not they create an account.
  3. “Members” means individuals who create an account on the Website and may access certain Member-only features.

 

Article 3 (Posting and Modification of Terms)

  1. The Company will make these Terms available through a clear and conspicuous link on the Website.
  2. The Company may update these Terms to reflect changes in law or business operations. Revised Terms will be posted at least 7 days prior to the effective date; provided, however, that revisions materially unfavorable to Users will be notified at least 30 days in advance.
  3. Continued use of the Services following the effective date of revised Terms constitutes acceptance of the updated Terms.

 

Article 4 (Supplementary Rules)

Any matters not addressed in these Terms shall be governed by:

  • Applicable U.S. federal and state laws, including consumer protection and e-commerce regulations; and
  • Generally accepted commercial practices within the United States.

 

Article 5 (Provision and Changes to Services)

  1. The Company provides the following Services through the Website:
    • Display of product listings and related information;
    • Order processing, payment handling, and delivery of purchased goods;
    • Any additional services that the Company designates from time to time.
  2. The Company may modify, discontinue, or update certain Services or product specifications for legitimate operational or technical reasons. When reasonably possible, Users will be notified of material changes in advance.

  1. The Company may temporarily suspend the Services for system maintenance, upgrades, or unavoidable technical issues.

Article 7 (Membership Registration)

  1. Users may create an account by submitting accurate information and agreeing to these Terms.
  2. The Company may decline or cancel registration if:
    • False, inaccurate, or misleading information is submitted;
    • The User previously violated these Terms; or
    • Registration poses technical, operational, or security risks.
  3. Users are responsible for keeping their account information accurate and up to date.

 

Article 8 (Membership Termination)

  1. Members may close their accounts at any time.
  2. The Company may suspend or terminate an account if the Member:
    • Engages in fraudulent activity or provides false information;
    • Fails to pay amounts owed;
    • Misuses the Services or interferes with other Users;
    • Violates applicable laws or these Terms.
  3. The Company will notify Members of intended termination and may, when appropriate, provide an opportunity to respond.

 

Article 9 (Notices)

Notices from the Company may be provided via email or by posting on the Website. Notices related to individual transactions will be sent directly to the User’s registered email address.

 

Article 10 (Purchase Application)

Before placing an order, the Website will provide Users with clear information regarding:

  • Product details and pricing;
  • Applicable shipping costs;
  • Accepted payment methods;
  • The Return & Refund Policy.
    Users place orders by completing the Website’s checkout process.

 

Article 11 (Order Acceptance)

  1. The Company may refuse an order if:
    • Submitted information is inaccurate or incomplete;
    • The order violates applicable laws (e.g., age-restricted products);
    • Fulfilling the order is not reasonably feasible.
  2. A binding purchase agreement is formed when the Company issues an order confirmation email.

No additional fees will be charged except those disclosed during checkout.

 

Article 13 (Order Confirmation, Changes, and Cancellation)

Users may request changes or cancellations before the order has shipped.
After shipment, cancellations follow the Website’s Return & Refund Policy.

Refunds and returns are governed exclusively by the Company’s Return & Refund Policy, available through a link on the Website.
This Policy forms an integral part of these Terms.

Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Indirect, incidental, special, or consequential damages;

The Company’s total liability for any claim shall not exceed the amount paid by the User for the relevant purchase.

 

Article 20 (Dispute Resolution)

Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, all Claims shall be resolved individually, without resort to any form of class action or any other kind of representative proceeding.

 

Article 21 (Governing Law & Venue)

These Terms shall be governed by the laws of the State of California.
If arbitration is not applicable, any legal action shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

 

Article 22 (Miscellaneous)

If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.
The Company’s failure to enforce any provision shall not constitute a waiver of its rights.

 

These Terms and Conditions shall be applicable from December 15, 2025.
